How do I know if the Regulatory Reform (Fire Safety) Order 2005 applies to me and my business or property?

There are few exceptions.

A Fire Risk Assessment is necessary in virtually all buildings other than domestic dwellings with similar requirements applicable under the Fire (Scotland) Act 2005 and the Fire and Rescue Services (Northern Ireland) Order 2005.

The RR(FS)O does not apply to: Domestic premises e.g. house/flat (however the order does apply to communal areas), offshore installations, ships, fields, woods or agricultural/forestry land, aircraft, trains, trailers, mines (other than any buildings onsite), boreholes

Do I need a Fire Risk Assessment if I have a small business with paying guests?

Yes, the Regulatory Reform (Fire Safety) Order 2005 is applicable if you have paying guests: e.g. if you run a bed and breakfast, guesthouse or let a self-catering property

What size does a business need to be before it requires a Fire Risk Assessment?

When your business has 5 or more employees you must start keeping a written record of your Fire Risk Assessment.

Who is responsible?

You are responsible for Fire Safety in business or other non-domestic premises if you are:

  • The Owner
  • An Employer
  • The Landlord
  • An Occupier
  • Anyone else with control of the premises: e.g. a Facilities Manager, Building Manager, Managing Agent or Risk Assessor.

You are known as the “Responsible Person”.

If there is more than one Responsible Person you will have to work together to meet your responsibilities. You legally have to co-operate and co-ordinate

Can I carry out my own Fire Risk Assessment?

Yes, you can – providing that you feel that you have the competence to do so.

You must have sufficient training, knowledge and experience for the environment being assessed.

London City Fire assessors can assist when a client does not have the necessary competence or when they do not have the time or resources to conduct the assessments themselves

Can anyone conduct a Fire Risk Assessment?

No, it is the duty of the Responsible Person to ensure that they appoint a competent person to complete the assessment if they are not completing the assessment themselves: failure to do so could result in a fine or otherwise if the assessment is found not to be suitable and sufficient

How do I know whether the assessor is competent?

Check that the assessors conducting the Fire Risk Assessment(s) have been audited by wither:

  • IFE – Institute of Fire Engineers
  • IFSM – Institute of Fire Safety Managers
  • FRACS
  • BAFE
Are all Fire Risk Assessments the same?

No, they can vary considerably depending on the experience and competency of the assessor as well as the “system” that they employ.

The system London City Fire employs is recognised throughout the industry as standard but is a comprehensive system to assess your fire safety.

What is the best method to use when conducting a Fire Risk Assessment?

There is no single correct or incorrect method of carrying out and recording the significant findings of a Fire Risk Assessment, there are many approaches that can lead to a suitable and sufficient fire risk assessment.

Which method do you use for Fire Risk Assessments?

We follow the 5 step Fire Risk Assessment process as recommended by HM Government guidance documents, HSE and the guidance documentation issued by Fire and Rescue Services:

  1. Identification of the Fire Hazards
  2. Identifying Persons at Risk
  3. Evaluation of the Risk (Eliminate, Reduce or Control)
  4. Recording of the Significant Findings
  5. Monitor and Review Process

A publicly available specification.

PAS 79 is a single method amongst many different approaches that can be taken that could meet the requirements of the Regulatory Reform (Fire Safety) Order 2005.

How often do I need to get a new Fire Risk Assessment?

Generally, a new Fire Risk Assessment would be conducted annually, however this really depends on your buildings and business.

The Fire Risk Assessment must be reviewed regularly to ensure it is up to date, with a new assessment being required if there has been a significant change or it is suspected that it is no longer valid.
